1. Acceptance of These Terms

By accessing or using this website (the “Site”), you confirm that you have read, understood, and agree to be bound by these Terms of Use (the “Terms”) and our Privacy Policy, which is incorporated by reference. If you are using the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Educational Purpose and No Guarantees

Fj ApS provides digital skills education, workplace productivity learning, business technology awareness programmes, and professional development resources for learners across Canada. All content and communication provided through the Site are for educational and professional development purposes only.

• We do not guarantee employment opportunities, financial results, business performance, career advancement, professional achievements, or specific outcomes.
• Participation in a programme does not create a guarantee of competence or suitability for a particular role or workplace requirement.
• Any examples, exercises, or templates are illustrative. Results vary based on context, implementation, and individual or organisational factors.

If the Site includes learning resources that reference third-party tools, platforms, or methodologies, those references are used to explain concepts. They are not endorsements, and they do not imply any partnership unless explicitly stated.

3. Description of the Site and Services

The Site functions as a corporate information website, a learning resource centre, and a contact and enrolment request channel. Fj ApS may provide programme descriptions, schedules, cohort information, digital knowledge articles, learning guides, and educational communications. Some parts of the Site may change over time, including the structure of programmes, availability of workshops, and the content of learning resources.

We may update, modify, suspend, or discontinue any part of the Site at any time. Where reasonable, we will aim to keep programme information current; however, information may be revised without prior notice.

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use and enjoyment of the Site. In particular, you must not:

• Attempt to gain unauthorised access to the Site, servers, or related systems, or probe, scan, or test vulnerabilities.

We may suspend or restrict access to the Site where we reasonably believe there has been a breach of these Terms, a security risk, or misuse that affects service quality.

5. Contact Requests and Submitted Information

When you submit a request through our forms, you agree to provide accurate and current information. You also acknowledge that communications may be handled via email and that delivery is subject to standard internet and email reliability factors outside our control.

Please do not include sensitive personal data in free-text fields (for example: health information, government identification numbers, or banking details). Fj ApS does not require such information for educational enquiries.

The Site, including its text, structure, design, graphics, brand elements, educational materials, and code, is owned by or licensed to Fj ApS and is protected by applicable intellectual property laws. All rights not expressly granted are reserved.

Fj ApS grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for your personal or internal organisational learning and evaluation purposes. You must not copy, reproduce, distribute, publicly display, publish, create derivative works from, or commercially exploit Site content without our prior written permission, except where such use is allowed by mandatory law.

To the fullest extent permitted by applicable law, Fj ApS disclaims all warranties and representations of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or uninterrupted operation.

While we aim to provide clear and accurate educational materials, the Site may contain errors or omissions. Content may be updated, restructured, or removed.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Fj ApS will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or anticipated savings, arising out of or related to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, Fj ApS’s total liability for any claim arising out of or relating to the Site or these Terms will be limited to the greater of (a) the amount paid by you to Fj ApS in the 12 months immediately preceding the event giving rise to the claim, or (b) EUR 100.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

10. Indemnification

You agree to indemnify and hold harmless Fj ApS from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with: (a) your misuse of the Site; (b) your breach of these Terms; or (c) information you submit through the Site that infringes the rights of another person or entity.

11. Force Majeure

Fj ApS is not responsible for any delay or failure to perform due to events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labour disputes, pandemics, government actions, power or network outages, internet disruptions, cyberattacks, or third-party hosting or infrastructure failures.

12. International Use

Fj ApS is established in Denmark and provides educational programmes to participants across Canada. Access to the Site may not be legal in all jurisdictions. You are responsible for complying with applicable local laws where you access the Site.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Denmark, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the courts of Copenhagen, Denmark, unless mandatory consumer protection laws provide otherwise.

If you are a consumer resident in the European Economic Area, you may also have the benefit of mandatory consumer rights in your country of residence, and nothing in these Terms is intended to limit those rights.

14. Dispute Resolution (Informal Process First)

Before initiating formal proceedings, you agree to contact us and provide a brief description of the issue. We will attempt to resolve disputes informally within 30 days. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief where appropriate.

15. Termination

We may suspend or terminate access to the Site at any time if we reasonably believe you have violated these Terms or used the Site in a way that creates a security risk. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law will survive termination.

16. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be replaced by a valid provision that most closely reflects the original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and Fj ApS regarding use of the Site and supersede any prior communications on the subject.

18. Assignment

Fj ApS may assign or transfer these Terms to an affiliate or successor entity in connection with a merger, acquisition, restructuring, or sale of assets. You may not assign these Terms without our prior written consent.

19. No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of Fj ApS.

20. Changes to These Terms

We may update these Terms from time to time. Changes become effective 14 days after posting on this page, unless a change is required by law or relates to urgent security matters, in which case it may be effective immediately. The “Last Updated” date indicates the most recent revision.

21. Electronic Communications

By using the Site and communicating with us electronically, you consent to receive communications from Fj ApS electronically. You agree that electronic records and signatures may have the same legal effect as written documents, to the extent permitted by applicable law (including EU eIDAS rules).
